A new Pentagon policy update aimed at eliminating discriminatory practices against pregnant service members has been completed and will be distributed in the coming days, the Defense Department's top diversity officer said Tuesday.

The changes were introduced in July by Defense Secretary Mark Esper as part of a package of changes aimed at rooting out "exclusion, prejudice and bias at all levels". Some changes will take place immediately, including a directive to stop using pictures on billboards. Others are directed to specific services or sectors with policy development deadlines.

Esper gave until September 1 to update the equal opportunities policy to "prohibit discrimination on the grounds of pregnancy" and until September 15 for the services to propose changes to hair and dress standards, including racial bias.
Cyrus Salazar, the Pentagon's director of diversity, equity and inclusion, told a meeting of the Defense Advisory Committee on Women in the Service on Tuesday that work on the preliminary policy is complete.
"And everything is fully packaged and actually registered, so it will be on the policy in the next few days," he said. "So [this is] a groundbreaking day for the department in terms of what we're going to do to make sure that we're adding the same protections for our civilian counterparts and for our service members."
Salazar explained that the previous policy protecting employees from pregnancy discrimination did not include military personnel. The federal Pregnancy Discrimination Act of 1978 applies only to civilian employees, and the Defense Department's directive governing discrimination extends pregnancy protections only to the department's civilians.

He noted that the Air Force had already approached his office in February with a proposed change, prompting meetings with Pentagon legal teams to ensure the policy could be changed without new legislation. However, Esper's memo was a shot in the arm, Salazar said, accelerating efforts to end the policy.
"For me, it's a big victory [against] pregnancy discrimination that we have equal protection not only for citizens, but also for service members," Salazar said.

It caught the attention of the legislator, Rep. Debra Haaland, D-New Mexico, introduced the National Security Authorization Act of 2021 to eliminate work breaks for pregnancy and parenthood.

Salazar said he could not reveal the specifics of the new policy, but noted that it would focus on defining the rules.
"It simply states that pregnancy discrimination, as a form of gender discrimination, will not be tolerated in the department," he said. "And we leave it up to the services to take the language and apply it to their owners, whether it's military training, Air Force training, or whatever."
The services will then have 90 days to develop their own policies in line with the Defense Department's guidance, he said.
